Client contract

This Client Contract (hereafter “Contract“), made between Motovilla (address: Toila municipality, Pühajõe village) and the Applicant/Client (hereafter separately „Party“ and together „Parties“), defines following:

1. Aim and object of the Contract

The aim of the Contract is to define providing accommodation in Motovilla and the terms and responsibilities of ordering and using accommodation, catering and other services in Motovilla.

1. Placing an order

1.1 By placing an order the Applicant agrees to be bound by and accept the terms and conditions of the Contract and the Contract becomes valid. The Applicant can place an individual order by inserting the data of guests to the booking form on our website. The applicant is also responsible for sending an email with the details of all other persons in the party, and the applicant is responsible for ensuring that the contractual obligations are met by all members of the party including the applicant him/herself

1.2 The Applicant or its contact person gives advance notice about requested services, which guest is will be in which room, and arrival time.

1.3 On arrival to Motovilla, all the Guests must check, specify and complete the details of the Client on the pre-filled Client Registation Form and sign it.

1.4 The Client is obligated to follow the House Rules. Otherwise the Renter has the right to charge the cost of replacing or repairing any items that are removed or damaged.

2. Confirmation

2.1 Motovilla accommodates the Clients according to reservation details (the amount of guests, requested rooms, check-in and check-out dates), if the requested number of rooms are available. The Prices of the rooms are set out in Appendix 1 or in a separate agreement. If the requested rooms are available, Motovilla will send the confirmation of the reservation to the Applicant´s email within 24 hours (Mon-Fri).

2.2 In the confirmation of the reservation will be confirmed the dates of check-in and check-out, the number of rooms, the types of rooms, other services, the cost of services and the terms of payment.

2.3 After the Client has made the payment, Motovilla will send the entrance codes, that will gain access to the building and reserved rooms. The Client is obligated to keep the codes secret from third parties.

2.4 Motovilla reserves the right to charge refundable security deposit (300 EUR) to cover the cost of any damage or breakage caused by the Client. The security deposit will be returned within 2 workdays (Mon-Fri) of departure.

3. Cancellation

3.1 The Applicant or its representative may cancel the reservation.

3.2 The cancellation due date is min 24 hours before arrival.

3.3 The Applicant may cancel the catering order or lessen the number of people in the group in the catering order 2 (two) days before due date. Otherwise the Applicant will be charged 100% of the total cost.

3.4 The group orders can be cancelled 5 (five) days before the due date. Otherwise the Applicant will be charged 50% of the total cost.

4. Payment

4.1 Motovilla will send the Invoice before (or upon settlement after) visiting Motovilla. The details of the booking are listed in the Invoice (ordered services, the Client´s or the Group´s name, dates, number and types of rooms).

4.2 After receiving the Invoice, the Applicant can make the payment by bank transfer.

4.3 The Applicant must make the payment before the due date detailed in Clause 4, otherwise the reservation will be cancelled.

4.4 If the Applicant doesn´t pay the Invoice by the due date, Motovilla reserves the right to charge the overdue charge 0.15% a day of the total cost.

4.5 In case of claim, Motovilla will send the Applicant an Invoice for a sum, that is the cost of used/ordered services without VAT.

5. Confidentiality

5.1 The Parties are obligated to keep the information of the Contract details and other knowledge of personal information secret.

6. General

6.1 Any dispute will be settled between the Client and the Renter. If agreement is not achieved, the dispute will be settled in the Courts of Estonia.

6.2 Appendices are inseparable parts of the Client Contract.
